首先是 Commodity Futures Trading Commission 人手不足，目前仅剩一名委员在任。在这种情况下，国会很难放心将更多加密监管职责交给该机构，而补齐人事本身就需要数月时间。其次，预测市场问题正在升温。是否将其纳入法案监管、以及可能涉及的内幕交易和政治利益冲突（包括与特朗普相关项目的争议），都可能让部分民主党议员转而反对法案。同时，围绕特朗普家族加密项目 World Liberty Financial 的持续争议，也在增加法案的政治敏感度，使跨党派共识更难形成。地缘政治也成为变量之一。有关伊朗可能使用加密支付的讨论，正在强化对反洗钱条款的关注，甚至可能引入对行业不利的修正案。此外，还有议员试图将《信用卡竞争法案》一并纳入，如果推进，可能引发新的利益冲突，进一步拖累整体立法。
