路透7月6日 - 周一，一名联邦法官驳回了美联航 UAL.O 试图驳回乘客诉讼的请求。这些乘客投诉称，他们额外付费购买了靠窗座位，却发现座位上根本没有窗户。
旧金山联邦地区法官詹姆斯·多纳托驳回了美联航的 (link) 辩护理由，即“靠窗”仅指座位相对于客舱壁和过道的相对位置，且该航空公司从未在合同中承诺靠窗位置的座位能看到窗外景色。
去年8月，乘客们发现自己在波音737、波音757和空客A321飞机上被安排坐在靠墙的位置后，便针对联合航空和达美航空 DAL.N 提起了拟议的集体诉讼 (link)。
他们称，这两家航空公司在预订过程中未明确披露座位旁缺少舷窗的情况。机舱壁有时会与飞机的运行部件（如空调风管）重合。
总部位于芝加哥的联合航空拒绝就该诉讼置评，但表示已“在选座流程中增加了更多细节，以便顾客在选择座位时能更清楚地了解实际情况”。
代表美联航乘客的律师尚未立即回应置评请求。
达美航空正寻求在纽约布鲁克林联邦法院驳回该诉讼。
多纳托驳回了美联航关于联邦法律优先于乘客索赔主张的论点。
他还指出，美联航的机票条款、登机牌及预订界面均明确声明，该航空公司将向付费购买的乘客提供靠窗座位。“现阶段，要推进违约索赔，已无需更多证据，”法官表示。
据原告称，乘客通常购买靠窗座位是为了缓解对飞行和晕机的恐惧、让儿童保持安静、获得更多光线，或是欣赏沿途风景。
这两起诉讼均要求赔偿数百万美元，涉及每家航空公司超过100万名乘客。
