But project developers and financiers warn the timeline and 50 MtCO2e cap could leave Brazil trailing early-moving competitors. Under the draft, Brazil would authorize ITMOs only from 2031, while competing countries enter from 2027. That four-year head start lets them build bilateral agreements, trading relationships and operational experience.\nThe draft resolution was published for public consultation on July 7. It sets out the conditions, procedures and limits governing Brazil’s participation in Article 6.2 cooperative approaches under the Paris Agreement. The framework would authorize up to 50 million tonnes of CO2 equivalent (MtCO2e) in Brazil ITMO transfers. These are linked to mitigation outcomes generated between 2031 and 2035, in the country’s first attempt to set operational rules and quantitative limits for Article 6.2 transactions. The proposal fulfills a requirement under Brazil’s regulated emissions trading system (SBCE), established by Law No. 15,042. Four ministries jointly prepared the draft: finance, environment, science and technology, and foreign affairs. The consultation runs until August 6.\n\nWhy the ITMO timeline worries carbon project developers\nCaio Franco is legal, policy and communications director of Brazilian carbon removal company Mombak. Speaking to reporters on July 22, he said timing could prove as important as the volume of ITMOs authorized.\nAccording to Franco, countries authorizing transfers from 2027 will have four years to build market experience and commercial relationships. This head start could put Brazilian projects at a competitive disadvantage.\nFor Mombak, the delay matters because compliance markets are becoming an important demand source for carbon removal projects.\n“In compliance markets, buyers do not buy just because they think it’s a good idea; they buy because they must buy,” Franco said.\nVoluntary carbon markets see corporate demand fluctuate with economic conditions and business priorities. Compliance markets create regulated demand, giving developers greater revenue certainty and better access to long-term financing.\nFranco’s concern echoes a warning raised earlier in the year by other market participants. Leonardo Fleck, managing director for sustainability at Santander Brasil, framed the delay as a first-mover problem for Brazilian climate finance. He spoke at Brazil Climate Investment Week in May.\n“The concern is that if we export our cheap credits now, it could become more costly for Brazil to meet its own goals in the future,” Fleck said. “But if we delay too much, other countries will occupy that space and attract the capital first.”\n\nHow Brazil set the 50 MtCO2e ITMO cap\nFranco also questioned the proposed 50 MtCO2e authorization limit. Higher-cost projects, he argued, may need broader access to international compliance markets to become financially viable.\nThe government has set out a detailed rationale for the figure. José Pedro Neves is deputy secretary of the Finance Ministry’s Extraordinary Secretariat for the Carbon Market. He told Fastmarkets on July 9 that the cap reflected three assessments: Brazil’s voluntary carbon market, expected domestic and international demand, and the emissions reduction potential of key mitigation activities.\nThe limit is intended to boost strategic mitigation projects, according to Neves. It also ensures that international transfers remain compatible with Brazil’s climate targets.\nOfficials also weighed the mitigation potential of activities strategic to the climate agenda. The assessment covered co-benefits and the expected Article 6 contribution to Brazil’s Nationally Determined Contribution (NDC).\n“The proposal seeks to provide an additional boost to projects considered strategic, taking into account factors such as co-benefits, technology transfer, contributions to government greenhouse gas mitigation programs, and climate justice,” Neves said.\nThe government views the proposed limit as a conservative starting point. It has built a mechanism into the draft regulation for periodic adjustments. These would reflect Brazil’s emissions trajectory and the mechanism’s performance. The proposal establishes a biennial monitoring and recalibration system. The cap could be revised downward if emissions exceed expectations. Neves argued they need not.\n“It is important to consider that ITMOs are not necessarily competitors to the fulfillment of Brazil’s NDC, but rather complementary instruments,” he said. “They can help drive mitigation and decarbonization projects that currently face financing or scaling constraints.”\nThe government expects the framework to stimulate demand for new carbon projects and credit generation over the medium term. This should also attract international investment and climate finance to Brazil. The periodic reviews should reassure international market participants about Brazil’s commitment to its climate goals. That confidence matters as the country expands its Article 6 participation.\n\nWhy credit quality may decide Brazil’s Article 6 success\nMombak’s concerns center on Brazil’s ability to compete for early investment. Other market participants argue speed alone will not determine the framework’s success.\nBrazilian decarbonization company ZEG said the mechanism could attract investment in high-integrity carbon projects. That depends on the final regulation establishing clear rules on transparency, traceability and environmental integrity.\nAccording to ZEG, those safeguards will be essential to building confidence among international buyers. They will also keep internationally transferred mitigation outcomes consistent with Brazil’s NDC.\nZEG also stressed the importance of balancing international carbon credit demand with Brazil’s domestic decarbonization objectives. Article 6 should help attract climate finance without undermining the country’s emissions reduction pathway.\nZEG said credit quality and credibility would determine the framework’s value.\n\nWhat to watch as Brazil’s Article 6 consultation closes\nThe proposals have exposed differing views over how Brazil should approach Article 6 market entry. The government presents its conservative volume and 2031 start date, backed by periodic recalibration, as a way to protect Brazil’s NDC. This approach also reassures international buyers of Brazil’s long-term commitment. Developers like Mombak argue the timeline cedes early advantage to competitors. It could also constrain projects dependent on compliance-market access. ZEG has focused on the quality of the final rules.
