原告指控酒店业主将实时价格和入住率等敏感内部信息输入软件制造商Cendyn的“Rainmaker”平台。 该平台利用人工智能辅助算法提供定价建议。
位于费城的美国第三巡回上诉法院裁定 (link)，这些指控足以依据联邦反垄断法继续推进诉讼，这与2025年8月位于旧金山的美国第九巡回上诉法院的裁决相左——后者驳回了 内华达州赌场顾客提起的类似诉讼 (link)。
美国地区法官威廉姆斯（Karen Williams）曾于2024年10月裁定，原告未能证明 (link) 新泽西州酒店在将据称属于机密的数据提供给Cendyn后，是如何使用这些数据的。
但第三巡回上诉法院合议庭表示，应给予原告机会收集有关该软件的技术证据，并在裁决书中写道：“人工智能软件能够通过使竞争对手在无需直接沟通的情况下协调价格并共享信息，从而助长串通行为。”
