原告指控该州的新税法违反了美国宪法、伊利诺伊州宪法以及《互联网税收自由法案》。争议的根源在于该税法规定，凡在该州开展业务或向居民提供服务的实体，若年收入超过 10 万美元，须缴纳 0.2% 的数字资产交易或存储税。尽管立法者预计该措施将每年为州预算筹集 6000 万美元，但原告表示，由于缺乏针对传统资产的对应税种，此举构成了对数字资产的‘独特惩罚性待遇’，涉嫌通过税码进行不公正的资源分配。
