ChainCatcher 消息，美国商品期货交易委员会（CFTC）市场参与者部门于 2026 年 9 月 17 日宣布，已向被动软件提供商发布不采取行动立场，该立场与员工函件 26-09 类似，现已广泛适用于此类提供商。
函件称，在符合若干指定条件的前提下，该部门不会建议委员会对任何此类提供商或其相关人员因未注册为介绍经纪商或介绍经纪商关联人而采取执法行动。该立场仅适用于其向用户提供并营销软件，以便用户与已注册期货佣金商、介绍经纪商及指定合约市场进行交易。
此事发生在姊妹机构美国证券交易委员会 SEC 发布创新豁免数小时之后。
