以案释法、以案促治、以案促建，执法和治理并重……近日，济南市市场监管局在市场监管总局举办的第三届价监竞争能力提升活动现场评审中获奖，市市场监管综合行政执法支队查办的一起AI数据“投喂”案在全国546起推荐案件中脱颖而出，获评十大优秀典型案例。

　　本案是全国市场监管在相关领域的首例案件。在办理过程中，执法人员密切配合，攻坚克难，持续深挖案源和线索，研究生成式引擎优化技术的运行逻辑，寻找投喂AI、污染数据源的真实目的，逐步厘清案件行为构成。同时，联合AI平台开展技术验证，明确定向投喂与生成内容之间的直接因果关系，完整还原“数据投喂—算法失真—误导用户”案件链条，最终依法作出行政处罚。

　　该案的查办旨在积极探索市场监管部门破解技术违法行为、护航AI生态治理的路径，不仅有效打击当下运用新技术实施的新型违法行为，也填补了AI领域不正当竞争执法的实践空白，形成针对全国同类案件查办可复制、可推广的执法样本，为AI生态治理提供系统性对策思路。

　　下一步，济南市市场监管综合行政执法支队将以此为契机，全面提升队伍综合执法能力，优化推动监管模式转型升级、加快智慧赋能执法步伐，持续强化电子数据取证技能，加大对隐蔽性、复杂性不正当竞争行为的打击力度，为营造全市更加稳定、透明的市场发展环境发挥更大作用。
